Your Rights & What to Consider
Borrow Rights For Payday Loans in Saskatchewan
A payday loan is a high-cost, short-term loan of up to $1,500, provided without collateral and typically due within 62 days.
Before taking out a payday loan, understand the total annual borrowing rate (ABR), which includes all fees, such as interest, application, setup, and administration charges. Payday loans often have a much higher ABR compared to credit cards. For example, borrowing $100 with a $17 fee for one week results in an ABR of 866%, far exceeding a typical credit card’s 28% APR.
Payday loans are due on your next regular payday. The loan agreement must be written, dated, and signed by you, and you should immediately receive a copy of all related documents, including any pre-authorized debit agreements.
Payday loans can only be for up to 50% of your take-home pay, and you’re limited to one loan at a time. Lenders require proof of your net pay through a pay stub or bank statement before approving a loan.
In Saskatchewan, payday lenders must be licensed with the FCAA. Avoid borrowing from unlicensed lenders.
Key tips for using payday loans:
- Understand the costs—frequent use adds up.
- Never take out a second payday loan to repay the first.
- If you change your mind, you can cancel the loan by returning the money by the end of the next business day.
- Always read the fine print.
- Use a licensed lender in Saskatchewan.
Maximum Fees
Payday lenders can charge up to $17 for every $100 borrowed. So, if you take out a $300 loan, you’ll owe $351 ($300 + $51) on your next payday. This total includes all associated costs, such as:
- Interest
- Loan administration or processing fees
- Application fees
- Brokerage fees
Defaulting on a Payday Loan
If you fail to repay a payday loan, the lender can:
- Charge default interest up to 30% per year on the overdue principal.
- Apply an NSF fee up to $25 if your payment is returned due to insufficient funds.
Only one NSF fee can be charged per loan agreement, no matter how many payments bounce. Lenders cannot impose any other fees, penalties, or costs for defaulting, and they are not allowed to charge extra for rolling over, refinancing, or extending your loan.
Collection Practices
If you authorize a lender to withdraw payments directly from your bank account:
- The lender can make one attempt to withdraw the agreed amount on the date specified.
- If the withdrawal fails, they can try once more within 30 days, but the second attempt must be for the same amount as the first.
Lenders are not allowed to make more than two attempts to withdraw funds using a pre-authorized debit (PAD).
Additionally, collection practices must comply with The Collection Agents Act, which includes the following rules:
- Lenders cannot collect more than what is owed or charge extra fees for collection.
- They cannot charge you for phone calls or telegrams made to collect the debt.
- They must not use forms resembling official court documents.
- They cannot make harassing phone calls or personal visits to you or your family members.
- No calls can be made on Sundays or holidays, and on other days, calls must be between 8 a.m. and 9 p.m.
- Lenders cannot provide false information or threaten to share information with your employer that could harm your job.
- They must clearly identify the lender, the amount owed, and the authority of the person making the demand when contacting you.
- Lenders cannot harass others in an attempt to locate you.
